What are your rights when you are wrongly detained?

One of the stories that continues to be a topic for conversation is the arrest of a 23 year old woman in Sea Point last Sunday, who was sitting on the promenade taking selfies when she was approached by police. Two cops searched her bag and found a garage remote and accused her of car jamming. She of course filmed the incident on her phone, and in the video, she can be heard questioning the police on their actions. Soon after she was taken to the police station and detained overnight. Police have said there is no prospects of successful prosecution. This woman plans to sue for wrongful arrest.
So it really got us thinking about how does one respond in such a situation. Naturally, one becomes angry and defensive in the moment...but what is the best way to respond and what is your legal recourse. To help us understand is VOCs legal expert Igshaan Higgins
