
Bizarre judgement in call to prayer is unlawful

Last week the KwaZulu-Natal High Court ordered a Madrassah in Durban to ensure that its call to prayer are not audible in the building of a neighbour's house across the street.
The judgement is badly argued and clearly wrong in law as the law requires neighbours to “live and let live”. But it also has the unfortunate effect of indirectly endorsing religious prejudice against the Islamic faith.
That is according to constitutional law expert and law professor at the University of Cape Town, (UCT), Professor Pierre de Vos.
