Information Regulator explains deferment of prior authorisation deadline

Last week the Information Regulator announced that the enforcement of powers pertaining to the Protection of Personal Information Act (POPIA) will still come into effect on 1 July, this is with the exception of applications for prior authoritsation. The deadline for applications has been extended to 1 February 2022. The OFM Business Hour sat down with Ntsumbedzeni Nemasisi he is the Executive: responsible for enforcement of Promotion of Access to Information Act (PAIA) at the Information Regulator to discuss the aforementioned deferment and ascertain which sections of the Act are already at play. ​

Nemasisi explained that technically all sections of the POPIA have come into effect last year with the exception of Section 110 which deals with the amendment of PAIA and section 114 (4) which has led to the deferment of the deadline for prior authorisation. This year was also a grace period for businesses to ensure compliance. After 1 July, the regulator’s compliance and monitoring units, will kick into gear. Furthermore as of July the Information Regulator takes the "PAIA function over from the South African Human Rights Commission" reveals Nemasisi.
