Land, Law and the Failure of Enforcement

Land, Law and the Failure of Enforcement | Part One This episode of Uncensored examines a land invasion currently unfolding on the North Coast of KwaZulu-Natal.

It is not a historical case. It is happening now.

Privately owned land has been occupied without consent. Plots have been measured and sold by people with no legal authority. Permanent brick houses have been built, and electricity and water connected unlawfully, all despite court orders meant to stop it.

In this episode, Penny Fourie speaks to property law expert Gavin Steinhobel about what the law requires when land is unlawfully occupied, who is responsible for enforcing court orders, and what happens when enforcement fails in practice.

This is the first episode in a series tracking how these cases unfold on the ground and through the legal system.
