South Africa’s asylum system is now open to all new applicants, including those who entered the country unlawfully or do not have a visa, following a Constitutional Court ruling. The Court struck down provisions that allowed asylum seekers to be excluded from the process without their claims being assessed on their merits, finding that this could undermine the principle of non-refoulement.
